What Do Real Estate Attorneys Do?

Business law issues

Litigation can be defined as an action brought in court to enforce a particular right. Litigation is basically the act of suing someone or bringing a lawsuit against a person or company for perceived wrong. Litigation is not criminal law, but rather civil law, and the results of a litigation case will be decided by a judge, and the penalty will be financial, involving no jail time for the parties.

A civil lawsuit can be settled out of court or follow the steps of the litigation process. A lawsuit actually begins when a complaint is filed in court. This complaint states that one or more plaintiffs seeks damages or equitable relief from one or more stated defendants, and identifies the legal and factual basis for doing so.

The plaintiffs and defendants are called litigants, while the attorneys are litigators. Litigation is generally handled by a business law lawyer, as almost all businesses have a lawyer on hand to handle such business law issues. Real estate, litigation, for example, is handled by a real estate attorney, which answer the question, “what do real estate attorneys do?”

But exactly what do real estate attorneys do, besides handling litigation? They help you understand contracts pertaining to real estate, both personal and commercial. For instance, a commercial real estate attorney would tell the company moving into the building what is expected of them, and also make sure the building is up to par with the laws and safety codes as defined by OSHA and other federal entities.

Real estate litigation refers to any dispute regarding property. A real estate attorney can step in and provide all the help you need in a case involving real estate litigation.

  1. I got my real estate license about 13 years ago, but I want to become a real estate attorney. I feel like I know enough now, and I can help people who want more information about real estate law. I feel like I can make a difference.
